A US judge has hinted that a lawsuit brought by Elon Musk's X Company (formerly Twitter) against the Center for Countering Digital Hate (CCDH) may be thrown out.
The lawsuit alleges that CCDH criticized the rise of hate speech on X's platform, causing a loss of advertisers and causing significant financial losses to Company X. During a recent hearing, U.S. District Judge Charles Breyer expressed doubts about Company X’s allegations against CCDH. The judge questioned whether CCDH could have foreseen Musk's acquisition of Twitter and subsequent policy changes, such as reinstating banned user accounts. The judge found CCDH could not have foreseen the changes when it originally agreed to the platform's user terms.

CCDH attorney John Quinn argued that the lawsuit seeks to stifle criticism and violates California's anti-SLAPP law designed to protect free speech.
