The judge made a ruling on the fake BAYC case: compensation of $9 million to BAYC

Artists Ryder Ripps and Jeremy Cahen are targeting Bored Ape Yacht Club founder Yuga Labs' counterclaims in the lawsuit were dismissed and an adverse order was issuedrequiring the pair to pay $9 million in disgorgement and other statutory damages.

In April 2023, it was reported that Yuga Labs targeted Rips and Kahn for creating unauthorized versions of Bored Ape Yacht Club (BAYC) non-fungible tokens (NFT) violations Copyright law charges were ruled in favor of Yuga Labs.

Previously, the two launched the Ryder Ripps BAYC (RR/BAYC) series in May 2022, leveraging the reputation of the well-known BAYC brand.

As a result, Rips and Kahn were ordered to pay Yuga Labs a total of $1.57 million in damages and legal fees to end the lawsuit.

However, according to a Feb. 2 court filing, the court dismissed Rips and Kahn's most recent counterclaim to the allegations. Rips and Kahn were ordered to pay nearly $9 million, including attorney fees, expert witness fees and disgorgement.

They were also instructed to dispose of any RR/BAYC NFTs in their possession:

"If the defendants are in possession of any RR/BAYC NFTs, they should destroy (e.g. by "burning" )NFT or provide it to Yuga to burn."

Kahn, who has 174,100 followers on The court's decision was appealed.

Rips and Kahn filed claims against Yuga Labs for intentional infliction of emotional distress, negligent infliction of emotional distress, and declaratory judgments for non-defamation.

The judge finalized Yuga’s first and third causes of action against Lipps and Kahn, alleging false origin and cybersquatting (the act of purchasing domain names to profit from a trademark) , while issuing millions of dollars in fines.

In addition,Rips and Kahn will also be required to turn over all social media accounts and smart contracts associated with the RR/BAYC NFT.

The document states: “Defendants shall destroy any and all other infringing materials in their possession or control that use any BAYC Marks, including NFTs, articles, documents, software, promotional items or Advertisement."
